It is therefore the body with which title applications should primarily be filed.<\/p>\n<p style=\"font-weight: 400;\"><strong>Industrial property aims to provide you with legal protection<\/strong> when you are the originator of an inventive creation and wish to keep a monopoly on exploiting it for 20 years, which is exactly the point of a patent. Indeed, without this legal tool, your competitors would be entitled to reuse and commercialize your invention.<\/p>\n<p style=\"font-weight: 400;\">Industrial property is therefore a key tool for your competitiveness if you are an innovative player in your market. Founders of tech start-ups preparing to raise funds know this well. In other words, you cannot file a patent on an obvious process available to everyone, for example \u201cfilling a glass with water.\u201d<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a6bbb7d elementor-widget elementor-widget-text-editor\" data-id=\"a6bbb7d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong><span style=\"color: #D211FF;\">Have an industrial application:<\/strong><\/p>\n<p>It is impossible to claim a common good or a natural effect that does not result from inventive or ingenious human work. But there are also situations in which it will be useful NOT to file a patent!<\/p>\n<p style=\"font-weight: 400;\"><strong>Filing a patent is like taking antibiotics: it\u2019s not automatic!<\/strong><\/p>\n<p style=\"font-weight: 400;\">Filing a patent will be worthwhile if it:<\/p>\n<ul>\n<li>lets you generate a real advantage over your competitors,<\/li>\n<li>or contributes favorably to your company\u2019s image or increases your chances of securing funding (PIA, fundraising, accelerators, R&amp;D tax credits\u2026).<\/li>\n<\/ul>\n<p style=\"font-weight: 400;\">But conversely, you will probably be better off protecting yourself in another way (and in particular preserving your future <a href=\"https:\/\/tkminnovation.io\/en\/freedom-to-operate\/\" target=\"_blank\" rel=\"noopener\">freedom to operate<\/a>) if, for example:<\/p>\n<ul>\n<li>Proving infringement will be difficult (reverse engineering)<\/li>\n<li>Your claims are very specific and could easily be worked around (by changing an ingredient or the proportions and composition of a recipe)<\/li>\n<li>Innovation cycles are so fast that obsolescence will catch up with the invention before the end of the patent application\u2019s examination cycle<\/li>\n<li>Or when you think it is actually in your interest to offer standards to the market by leaving the technology royalty-free<\/li>\n<\/ul>\n<\/div>\n<p><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bdaca62 elementor-widget elementor-widget-menu-anchor\" data-id=\"bdaca62\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"menu-anchor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-menu-anchor\" id=\"partie-3\"><\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-65c1e2e7 elementor-widget elementor-widget-text-editor\" data-id=\"65c1e2e7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<div>\n<h2>AND ONCE THE PATENT IS FILED?<\/h2>\n<p style=\"font-weight: 400;\">Filing your patent application is not the end of the journey. For this investment to be genuinely useful, you will now need to (even more so) <strong><a href=\"https:\/\/tkminnovation.io\/en\/patent-analysis-software\/\" target=\"_blank\" rel=\"noopener\">monitor your competitors\u2019 patent filings<\/a><\/strong>!<\/p>\n<p style=\"font-weight: 400;\">Why?<\/p>\n<p style=\"font-weight: 400;\">This monitoring serves several purposes:<\/p>\n<ul>\n<li><strong>Making sure over time that the expenses<\/strong> you continue to incur (geographic extensions, annual maintenance of rights) remain justified and useful. Conversely, continuing to maintain an obsolete patent, or one that has been worked around a hundred times, no longer serves any purpose.<\/li>\n<\/ul>\n<ul>\n<li><strong>Watching for potential infringers<\/strong>: monitoring your competitors and their future filings, and if necessary intervening with the patent office when it is about to grant a favorable decision on a disputed competing patent. You could always challenge it later before the relevant courts, but this will be more costly and also riskier.<\/li>\n<\/ul>\n<ul>\n<li><strong>Weakening competing patent applications<\/strong>: keeping track of the competition is a good way to block the grant of a patent that could prove troublesome for your company.
